Personal Statement
  • Dear Voter, It has been my privilege to serve as a judge in the City of Rochester and Town of East Rochester courts for nearly 16 years. During that time I have heard and decided thousands of cases encompassing many aspects of the law, both criminal and civil, involving individuals and families from all walks of life. Supreme Court is both a criminal and civil court. I believe my years of experience as a sitting judge, in combination with almost two decades of experience in private practice, have prepared me well to make a difference in even more lives. The oath that judges swear says that we will uphold the Constitution of the United States and the laws of the State of New York. These words are more than just a formality, more than just a ceremony. This is the high standard that I dedicate myself to each and every time I put on my robe and take my seat behind the bench. Professional Experience
  • Acting Judge Rochester City Court, 2003 to present.  Preside over preliminary felony matters, all class A and B misdemeanors, violations and vehicle and traffic matters that occur within the City of Rochester, as well as summary proceedings (landlord/tenant) and civil and small claim matters. Handle entire docket for absent Rochester City Court Judges which includes presiding over all court appearances, motions, hearings and bench and jury trials.  Review all motions, and render decisions on motion calendar, hearings and trials.
  • East Rochester Town Justice, 1997 to present.  Preside over preliminary felony matters, all class A and B misdemeanors, violations and vehicle and traffic matters that occur within the town/village, as well as summary proceedings and civil small claim matters.  Interpret Village ordinances/codes and preside over all village/town ordinance violations.  President of the Monroe County Magistrates Association [2004]. Represented all 46 Town and Village Justices and 22 Town and Village Courts in Monroe County on issues and legislation that affect local courts and judges.
  • Partner, The Odorisi Law Firm, 1994 to present.  Form corporations, limited liability companies, joint ventures and partnerships. Draft articles of organization, bylaws, operating agreements, minutes, shareholder agreements, office sharing agreements, partnership agreements and employment agreements. Represent major national franchises and lending institutions in various corporate matters.  Represent clients in the purchase and sale of businesses including restaurants and major franchises. Draft contracts, leases and other agreements regarding the same.  Represent clients in the buying and selling real estate. Examine abstracts, title insurance and instrument surveys. Draft various contracts and leases, mortgages, deeds, easements and right of way agreements.  Counsel clients on complex estate planning issues and the implications of Medicare/Medicaid qualification rules and estate and gift taxes. Draft wills, living wills, health care proxies and powers of attorney.  Represent clients in criminal matters in town and city court including motions and court appearances.  Represent clients in Chapter 7 and Chapter 13 Bankruptcy Proceedings in United States Bankruptcy Court and counsel clients on debt consolidation and ramifications of filing bankruptcy.  Appear in all trial level New York State Courts and various New York State Administrative Agencies.
  • Attorney, Harris Beach, 1997-1999.  Assisted in the affiliation of numerous multi-million dollar not for profit health care organizations, conducted pre affiliation due diligence, drafted corporate affiliation documents such as memorandums of understanding, Certificates of Incorporation and applicable Amendments, corporate bylaws, proxies and board resolutions and assisted in obtaining various third party approvals.  Completed complex legal research and prepared memos on numerous federal and state health care regulatory matters including various Medicare/Medicaid Part A and Part B billing issues and other daily health care treatment issues. Counseled not for profit health care organizations and physician practices on the corporate practice of medicine doctrine, fee splitting, Anti kickback and Stark prohibitions.  Drafted and reviewed various hospital policies, exclusive hospital service contracts, vendor agreements and medical staff bylaws.  Assisted in defending corporate clients in Department of Justice investigations regarding alleged violations of the False Claims Act which involved laboratory billing issues. Drafted and reviewed tolling agreements, position papers, requisition forms and memos on complex laboratory Medicare payment issues.
